These Terms of Service (“Terms”) form a legal agreement between you (“User”) and Send Mega Ltd. (“Send Mega,” “we,” “our,” or “us”). They govern your access to and use of our websites, mobile apps, and related file transfer services (collectively, the “Service”).

By using Send Mega, you agree to these Terms. If you do not accept them, you must not use the Service.

User Eligibility and Accounts

• You must be legally able to enter into a binding agreement.
• The Service is not intended for users under 16 years of age.
• You must provide accurate and complete account information and keep your login credentials secure.
• For team accounts, the account owner/administrator is responsible for all users linked to the account.
• We may deactivate inactive accounts after 12 months of non-use, unless tied to a paid subscription.

Content Ownership and License

• You retain full ownership of the files and content (“Content”) you upload.
• You grant us a limited, worldwide, royalty-free license to store, transmit, process, and display your Content solely for operating and improving the Service.
• You are solely responsible for your Content, including securing backups and ensuring compliance with laws.

Acceptable Use and Restrictions

• Do not upload, share, or distribute unlawful, harmful, or infringing material.
• Do not violate intellectual property or privacy rights.
• Do not reverse-engineer, decompile, or misuse the Service.
• Do not use automated systems (e.g., bots, scrapers) to extract data.
• Do not misuse reporting, takedown, or moderation tools.

We reserve the right to suspend or terminate your account if you violate these Terms.

Subscription Plans and Fees

• Certain features are available only through paid subscription plans.
• Subscriptions automatically renew unless cancelled before the billing date.
• All fees are non-refundable unless required by law.
• We may change subscription prices with reasonable prior notice.
• Payments may be subject to third-party processing fees.

Intellectual Property

• Send Mega, our software, designs, and trademarks are protected by intellectual property laws.
• Except for your Content, all rights in the Service belong to Send Mega or our licensors.
• By submitting feedback, you grant Send Mega a royalty-free right to use it for service improvement.

Content Moderation and Takedowns

• We may review and remove Content that violates laws, rights, or these Terms.
• Copyright owners may submit takedown requests to legal@sendmega.com.
• Users may appeal takedown decisions by contacting us.

Paid Transfers (Optional Feature)

• Send Mega may allow “Sellers” to offer files for sale to “Buyers.”
• Send Mega is not a party to these transactions and does not process payments or resolve disputes.
• Sellers are responsible for complying with tax, refund, and consumer protection laws.

Third-Party Content and Advertising

• The Service may include third-party links, ads, or integrations.
• Send Mega does not endorse and is not responsible for third-party content or services.

Dispute Resolution

• Most disputes must be resolved through binding individual arbitration.
• Exceptions: small claims cases and intellectual property claims.
• Users may opt out of arbitration within 30 days of first accepting these Terms by emailing support@sendmega.com.

Liability and Indemnification

• The Service is provided “as is,” without warranties of uninterrupted availability or error-free performance.
• Send Mega’s liability is limited to the greater of $100 or the amount you paid us in the past 12 months.
• You agree to indemnify and hold Send Mega harmless from claims related to your Content or Service misuse.

EU and Other Regional Rights

If you are an EU user, you may have additional rights under consumer protection regulations, including access to complaint handling and mediation services.

App downloads from third-party marketplaces (e.g., Apple App Store, Google Play) are governed by their terms. Send Mega remains responsible for the app’s functionality.

Termination

• You may stop using the Service at any time.
• We may suspend or terminate your account if you violate these Terms, applicable laws, or pose a risk to the Service.

Changes to Terms

We may update these Terms from time to time. If significant changes are made, we will notify you by email or via the Service. Continued use after changes constitutes acceptance.

• Ads are never inserted into user-transferred files.
